BODA TRAVEL – TERMS & CONDITIONS

These Boda Travel Terms & Conditions (“Terms”) govern the access to and use of the Boda Travel mobile application, related website(s), backend systems, support channels, booking tools, payment flows, and all related services, software, and infrastructure made available by Coreare Technologies (“Coreare”, “Boda”, “we”, “us”, “our”).

These Terms apply to all users, customers, travelers, visitors, tourists, or clients (“Traveler”, “Customer”, “you”, “your”) who access, register for, book through, or otherwise use Boda Travel.

By downloading, installing, accessing, registering with, or using Boda Travel, or by tapping “I agree”, “Accept”, “Continue”, “Book”, “Sign up”, or any equivalent button, you confirm that you have read, understood, and agreed to be legally bound by these Terms. If you do not agree, you must not use Boda Travel.

These Terms form a binding electronic contract between you and Coreare.


1. Introduction and Acceptance

1.1 Boda Travel is the customer-facing application of the Boda platform, made available by Coreare Technologies for the purpose of allowing Travelers to discover, request, book, and manage time-based, in-person guide or accompaniment services performed by independent Guides in supported service areas.

1.2 These Terms govern your relationship with Coreare in connection with your use of Boda Travel and the related Platform features.

1.3 By using Boda Travel, you agree to comply with:

  • these Terms;
  • any applicable in-app rules, policies, guidance, standards, or notices made available by Coreare;
  • all applicable local, national, and international laws relevant to your conduct and use of the Platform.

1.4 If you are booking or acting on behalf of another person, group, organisation, or legal entity, you represent and warrant that you are authorised to do so and to bind such person or entity to these Terms to the extent applicable.


2. Definitions

For the purpose of these Terms:

2.1 “App” means the Boda Travel application and any related interfaces, backend tools, support systems, or booking components operated by Coreare.

2.2 “Platform” means the full Boda technology ecosystem, including Boda Travel, Boda Guide, related APIs, support tools, payment integrations, and connected infrastructure.

2.3 “Traveler” or “Customer” means the end user who requests, books, receives, or attempts to receive a service through the Platform.

2.4 “Guide” means an independent guide, freelance guide, local companion, or similar service provider using the Boda Guide side of the Platform.

2.5 “Booking” means a service request placed through the Platform and accepted or confirmed through the Platform workflow.

2.6 “Service” means the in-person guide, accompaniment, orientation, or similar local service performed by the Guide for the Traveler through the Platform.

2.7 “Service Area” means the city, district, zone, or operational perimeter in which Boda enables or supports bookings.

2.8 “Geofence” means any virtual geographic boundary, radius, polygon, or location-based service perimeter used by the Platform for matching, availability, operational control, or booking validation.

2.9 “Booking Price” means the amount shown or calculated in connection with a Booking, subject to the rules of these Terms.

2.10 “Off-Platform Arrangement” means any direct arrangement between a Traveler and a Guide made outside the Platform after the parties were first introduced through the Platform.

2.11 “Applicable Law” means any law, rule, regulation, order, local restriction, consumer protection requirement, tourism rule, privacy rule, or court or administrative act applicable to the use of the Platform or the Service.


3. Nature of the Platform

3.1 Boda is a technology platform that facilitates discovery, matching, booking coordination, payment handling, and related administrative support between independent Guides and Travelers.

3.2 Coreare does not itself provide the in-person guiding service unless expressly stated otherwise in a separate written agreement.

3.3 Unless expressly stated otherwise in writing, Coreare is not:

  • a tour operator;
  • a package holiday organiser;
  • a traditional travel agency;
  • a transport provider;
  • a taxi, ride-hailing, or chauffeur operator;
  • a hotel, accommodation provider, or ticketing provider;
  • a bodyguard, security service, rescue service, or emergency response provider.

3.4 The actual in-person service is performed by the independent Guide. Coreare provides the technology platform and related operational tools only.

3.5 You acknowledge and agree that Coreare does not guarantee the availability, quality, legality, suitability, compatibility, or personal chemistry of any particular Guide beyond the operation of the Platform and any checks expressly described by us.


4. Eligibility and Account Registration

4.1 To use Boda Travel, you must:

  • be at least 18 years old;
  • have legal capacity to enter into binding agreements;
  • provide accurate, current, and truthful account information;
  • use the Platform only for lawful purposes.

4.2 You must not:

  • create an account using false information;
  • impersonate another person;
  • allow another person to misuse your account;
  • maintain multiple accounts for fraudulent, abusive, or manipulative purposes;
  • create accounts in order to evade previous restrictions or suspensions.

4.3 You are responsible for:

  • maintaining the confidentiality of your login credentials;
  • all activity under your account;
  • promptly updating inaccurate information;
  • ensuring your device and account remain secure.

4.4 We may suspend, restrict, or terminate your account if we suspect fraud, misuse, false identity, abusive conduct, chargeback abuse, or any breach of these Terms.


5. Booking Flow and Geofenced Availability

5.1 Through Boda Travel, you may request a Guide in a supported area by entering or selecting relevant booking information, which may include:

  • meeting point;
  • city or area;
  • estimated duration;
  • date and time or immediate request;
  • language or service preference where available;
  • additional notes relevant to the Booking.

5.2 A Booking is not confirmed merely because you submit a request. A Booking is formed only once it is accepted or otherwise confirmed through the Platform workflow.

5.3 The Platform operates on a location-based and geofenced model. This means availability may depend on:

  • whether your request falls within an active Service Area;
  • whether there is a Guide available within the relevant geofence or operational range;
  • location data, timing, technical availability, and other matching factors.

5.4 You acknowledge and accept that:

  • some areas may have no available Guides;
  • availability may vary significantly by city, day, time, weather, demand, or technical conditions;
  • GPS and geolocation technology are inherently imperfect;
  • the Platform may reject, cancel, or fail to dispatch a Booking outside supported geofences or due to technical or operational reasons.

5.5 Coreare does not guarantee that every Booking request will be accepted or completed.


6. Meeting Point, Service Timing and Extensions

6.1 You are responsible for selecting a lawful, reasonably clear, and reasonably safe meeting point.

6.2 You must ensure that:

  • the meeting point is accurate and understandable;
  • you are reachable through the contact methods enabled by the Platform;
  • you are present on time or otherwise reasonably available for the start of the service.

6.3 The Booking may be timed according to one or more operational factors, including:

  • scheduled start time;
  • Guide arrival;
  • in-app “start” action;
  • in-app “complete” action;
  • approved extensions;
  • no-show or cancellation outcome.

6.4 The estimated duration selected when requesting the service is not necessarily the final billable duration if:

  • the session starts late for reasons attributable to you;
  • the session is extended;
  • the session is shortened or cancelled;
  • the official time is adjusted based on in-app records or dispute review.

6.5 Extensions may only be made through the Platform where that function is available. You must not arrange direct off-platform extensions with the Guide for the purpose of avoiding Platform rules or payment flows.


7. Prices, Estimates and Payments

7.1 Before confirming a Booking, the Platform may display some or all of the following:

  • hourly or time-based pricing;
  • minimum charge;
  • estimated total amount;
  • booking-related fees;
  • taxes where applicable;
  • available payment method(s).

7.2 Any estimate shown before the Booking is confirmed is informational unless the Platform expressly states otherwise.

7.3 Final charges may vary due to:

  • actual service duration;
  • Booking extensions;
  • no-show fees;
  • cancellation timing;
  • promotions, discounts, credits, or coupons;
  • taxes or legally required adjustments;
  • dispute outcomes;
  • technical corrections or clerical errors.

7.4 Payments may be processed through external payment service providers such as StripePayPal, or other approved third-party processors made available through the Platform.

7.5 By making a payment through the Platform, you authorise the relevant payment provider and Coreare, to the extent necessary, to:

  • charge the selected payment method;
  • place a hold or pre-authorisation where applicable;
  • capture, complete, adjust, or reverse the charge in accordance with the Booking outcome and these Terms.

7.6 Coreare is not a bank, payment institution, or issuer of your payment instrument unless expressly stated otherwise.

7.7 You are responsible for ensuring that your chosen payment method is valid, sufficiently funded, and lawfully usable.

7.8 If a payment fails, is reversed, is disputed, or cannot be collected, we may:

  • retry collection where lawful;
  • suspend or restrict your account;
  • cancel current or future Bookings;
  • recover unpaid sums by lawful means.

8. Cancellations, No-Shows and Refunds

8.1 You may cancel a Booking through the Platform, subject to the cancellation rules shown in-app or otherwise communicated at the time of booking.

8.2 Depending on timing, status, and operational circumstances, cancellation may result in:

  • no charge;
  • partial charge;
  • minimum fee charge;
  • full or partial forfeiture of prepaid or pre-authorised sums to the extent permitted by law and disclosed before booking.

8.3 If you fail to appear, are materially late, are unreachable, provide an unusable meeting point, or otherwise prevent the service from being reasonably performed, the Booking may be treated as a no-show and charged accordingly.

8.4 If a Guide fails to appear or the service cannot be reasonably performed due to Guide-side failure, you may be eligible for a rebooking, credit, full refund, partial refund, or other adjustment as determined by Coreare in light of the circumstances and any applicable mandatory consumer law.

8.5 Refunds, credits, and goodwill gestures are assessed by Coreare in its discretion unless otherwise required by law.

8.6 Where the service is booked for a specific date or period or begins promptly at your request, any statutory right of withdrawal may be limited or excluded to the extent permitted by applicable consumer law.


9. Traveler Conduct Rules

9.1 You agree to use the Platform and the Service lawfully, respectfully, and in good faith.

9.2 You must not:

  • harass, threaten, intimidate, discriminate against, assault, or exploit any Guide, user, or member of staff;
  • request illegal, unsafe, or prohibited services;
  • pressure a Guide into acting outside the lawful scope of the service;
  • request or expect transport unless such service is explicitly activated by the Platform and lawful in the relevant area;
  • request security, bodyguard, law-enforcement, medical, legal, immigration, or emergency intervention;
  • use the Platform to commit fraud, abuse refunds, or abuse chargebacks;
  • create fake complaints, fake ratings, or false incident reports;
  • attempt to obtain services off-platform to circumvent Platform rules or fees;
  • upload unlawful, defamatory, obscene, hateful, infringing, or misleading content;
  • misuse Guide personal data or contact details.

9.3 You remain solely responsible for your own conduct, choices, travel plans, route decisions, personal belongings, health, physical condition, and compliance with local law during and after the service.


10. Scope and Limits of the Guide Service

10.1 The Guide’s role is limited to providing lawful in-person local guidance, accompaniment, orientation, or similar services as made available through the Platform.

10.2 Unless expressly enabled by the Platform and lawful in the relevant jurisdiction, the Guide does not provide:

  • transport;
  • hotel or accommodation services;
  • security protection;
  • emergency rescue;
  • regulated medical advice or healthcare;
  • legal or immigration advice;
  • official government representation;
  • any regulated service requiring a licence that the Guide does not hold.

10.3 You acknowledge that the Guide is an independent service provider and not an employee, partner, or representative of Coreare.

10.4 Any route suggestions, local recommendations, historical information, practical tips, or conversational content provided by the Guide are provided under the Guide’s own responsibility and may be subjective, incomplete, or affected by local conditions.


11. Ratings, Reviews and Communications

11.1 After a Booking, the Platform may allow you to rate and review the Guide and may also allow the Guide to rate or review you.

11.2 Ratings and reviews must be honest, relevant, lawful, and non-abusive.

11.3 You must not use reviews to:

  • extort refunds;
  • threaten a Guide;
  • publish false accusations;
  • disclose private or unnecessary personal data;
  • engage in harassment or discrimination.

11.4 Coreare may remove, hide, moderate, refuse, or investigate any rating, review, or communication that it reasonably considers unlawful, abusive, irrelevant, fraudulent, misleading, defamatory, or otherwise inconsistent with these Terms.

11.5 Support requests, complaint messages, and operational communications may be logged, reviewed, and used by Coreare for platform management, quality, safety, fraud prevention, and legal compliance.


12. User Content

12.1 If you upload text, messages, notes, images, attachments, or other content through the Platform, you confirm that:

  • you own the content or have the right to share it;
  • the content is lawful;
  • the content does not infringe the rights of third parties;
  • the content does not contain malicious code or unlawful material.

12.2 You grant Coreare a non-exclusive, worldwide, royalty-free licence to host, reproduce, store, display, process, moderate, and use such content solely for the operation, improvement, support, security, enforcement, and lawful administration of the Platform.

12.3 We may remove content that we reasonably consider unlawful, infringing, unsafe, irrelevant, abusive, fraudulent, or technically harmful.


13. Account Restriction, Suspension and Termination

13.1 Coreare may restrict, suspend, delist, or terminate your account, temporarily or permanently, where reasonably necessary, including in cases of:

  • fraud or suspected fraud;
  • identity manipulation or false information;
  • abusive behaviour;
  • repeated false complaints;
  • no-show abuse;
  • payment default;
  • chargeback abuse;
  • serious or repeated breach of these Terms;
  • legal or safety concerns;
  • authority requests;
  • misuse of personal data;
  • off-platform circumvention.

13.2 Coreare may also apply lighter restrictions where appropriate, including:

  • blocking new bookings;
  • limiting payment methods;
  • disabling certain features;
  • placing the account under review.

13.3 You may stop using the Platform at any time and may request account deletion or closure through the App or support, subject to:

  • pending Bookings;
  • unresolved payments or negative amounts owed;
  • open disputes;
  • legal retention obligations.

13.4 Suspension or termination does not eliminate your liability for prior conduct, unpaid charges, fraudulent activity, or legal claims.


14. Privacy and Data Protection Reference

14.1 Your use of the Platform is also subject to the Boda Privacy Policy, as updated from time to time.

14.2 For Platform-related data processing, Coreare generally acts as the data controller in respect of the purposes and means of processing connected to operation of the Platform.

14.3 Infrastructure, hosting, support, communication, analytics, or storage services may be provided through third-party providers, including hosting providers such as Hostinger or equivalent suppliers selected by Coreare.

14.4 Payment-related processing may be handled by external payment providers such as StripePayPal, or other approved processors, which may apply their own legal terms and privacy notices to the parts of processing they independently manage.

14.5 You agree to provide only information reasonably necessary for the Booking and to use the Platform in a manner consistent with Applicable Law and the privacy rights of others.


15. Intellectual Property

15.1 The Platform, including the App, its software, workflows, design, trademarks, logos, text, structure, databases, and related materials, is owned by Coreare and/or its licensors and is protected by intellectual property law.

15.2 Subject to your compliance with these Terms, Coreare grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to use Boda Travel solely for your personal and lawful use of the Platform.

15.3 You must not:

  • copy, reproduce, republish, or exploit the Platform except as permitted by law;
  • reverse engineer, decompile, or attempt to derive source code;
  • scrape or extract Platform data on a large scale;
  • use Coreare or Boda branding without written permission;
  • use the Platform to build or assist a competing service through unauthorised means.

16. Disclaimers

16.1 To the fullest extent permitted by law, the Platform is provided on an “as is” and “as available” basis.

16.2 Coreare does not warrant that:

  • the Platform will always be available, uninterrupted, secure, or error-free;
  • geolocation, maps, dispatching, notifications, timing records, or payment flows will always function correctly;
  • every request will result in a confirmed Booking;
  • every Guide will be available, punctual, compatible, or satisfactory to your preferences;
  • any historical, cultural, practical, or local information shared during the service will be complete, accurate, or suitable for your purposes;
  • local circumstances, crowds, access restrictions, weather, strikes, public closures, or third-party issues will not affect the experience.

16.3 You acknowledge that real-world services are affected by variables outside Coreare’s control, including Guide conduct, public conditions, local restrictions, transport disruption, weather, crowd levels, map inaccuracies, and other third-party factors.


17. Limitation of Liability

17.1 To the fullest extent permitted by law, Coreare shall not be liable for:

  • acts or omissions of Guides, Travelers, or third parties;
  • personal disagreements, dissatisfaction, or incompatibility between Traveler and Guide;
  • missed appointments, missed reservations, missed flights, lost opportunities, or itinerary changes;
  • loss of profits, revenue, goodwill, data, opportunity, or expected savings;
  • indirect, incidental, consequential, special, punitive, or exemplary damages;
  • technical failures caused by third-party providers, including payment processors, hosting providers, map systems, telecom operators, app stores, or banks.

17.2 You remain solely responsible for:

  • your own travel decisions;
  • your schedule and itinerary;
  • your belongings and personal security;
  • your compliance with local law;
  • determining whether the service is suitable for your needs.

17.3 To the maximum extent permitted by law, if Coreare is found liable for any claim arising out of or connected with the Platform or these Terms, Coreare’s total aggregate liability shall not exceed the total amount paid by you to Coreare through the Platform in connection with the relevant Booking or, if higher and required by law, the total amount paid by you through the Platform in the twelve (12) months preceding the event giving rise to the claim.

17.4 Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud or for death or personal injury caused by negligence where mandatory law so requires.

17.5 Except where prohibited by mandatory law, any claim arising out of or relating to the Platform or these Terms must be brought within one (1) year from the date the cause of action arose, otherwise it shall be permanently barred.


18. Consumer Law Notice

18.1 Nothing in these Terms is intended to remove or reduce any mandatory consumer rights that apply to you under Applicable Law.

18.2 If you are a consumer resident in the European Union or another jurisdiction granting mandatory consumer protections, those non-waivable protections continue to apply to the extent required by law.

18.3 In the event of conflict between these Terms and mandatory consumer law, the mandatory law shall prevail to the extent of the conflict.


19. Changes to the Terms

19.1 Coreare may update these Terms from time to time to reflect changes in:

  • law or regulation;
  • Platform features or workflows;
  • pricing logic;
  • payment systems;
  • support processes;
  • operational model;
  • fraud-prevention or safety controls.

19.2 Where changes are material, Coreare may provide notice in the App, by email, on the website, or through another reasonable communication method.

19.3 By continuing to use the Platform after the effective date of updated Terms, you agree to the updated Terms to the extent permitted by law.

19.4 If you do not agree with the updated Terms, you must stop using the Platform and may request account closure.


20. Governing Law, Jurisdiction and Dispute Resolution

20.1 These Terms shall be governed by and construed in accordance with the laws of Italy, without prejudice to any mandatory consumer laws that may apply in your country of residence.

20.2 Any dispute arising out of or in connection with these Terms, the Platform, or your use of Boda Travel should first be addressed in good faith through direct contact with Coreare at [INSERT LEGAL/SUPPORT EMAIL].

20.3 If the dispute cannot be resolved amicably, it shall be submitted to the competent courts of Italy, unless mandatory consumer law requires otherwise.


21. Miscellaneous

21.1 If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

21.2 Coreare’s failure to enforce any provision shall not constitute a waiver of that provision or any other right.

21.3 You may not assign or transfer your rights or obligations under these Terms without Coreare’s prior written consent.

21.4 Coreare may assign or transfer these Terms or any rights under them as part of a merger, reorganisation, acquisition, sale of assets, restructuring, or operational transfer.

21.5 These Terms constitute the entire agreement between you and Coreare regarding Boda Travel, except for any separate written agreement expressly signed by Coreare.
